Some Owners Claim Trucks Surge Forward
Victor Downin of Foresthill is one frustrated Toyota Tacoma owner.He was among three people who told KCRA 3 in November about problems with their 2007 Tacomas suddenly accelerating or lurching forward."It's not going to get any better, and it's miserable to drive," Downin said.According to federal documents, there are about 365,000 2006-07 Tacoma trucks on the road.At the time of KCRA 3's first report, there were 20 people nationwide who filed the same complaints with the National Highway Traffic Safety Administration. That number has grown to 32."Nobody is happy with their cars," Downin said.Three weeks after KCRA 3's November report, NHTSA opened up an investigation into the problem, but the results were less-than-satisfying to Downin.The Tacoma's accelerator control system passed NHTSA's safety compliance investigation."The car complied with the laws the way it's written," Downin said.Unsatisfied, some owners challenged the findings, and one of them filed another complaint with the agency's Office of Defects Investigation, or ODI.Documents show NHTSA has asked Toyota to provide investigators with documentation of all consumer complaints, field reports, reports involving crashes and injury or fatalities based on claims against the manufacturer.NHTSA has also asked for all third-party arbitration proceedings -- which gives Downin some hope."I went through arbitration, and I lost out there," he said.As a new federal investigation gets under way, Downin said he's ready to join any potential legal action."If it ever gets started, I'll be right there," he said.
